What is a California prenup?

A couple considering one should start well before the wedding rather than present it as a last-minute demand.
A prenup may address characterization of property, management and disposition of property, debt responsibility, spousal support, life-insurance or estate-planning coordination, and other rights permitted by law. It cannot be used as a shortcut to decide child custody or child support in a way that binds a court’s later best-interest or support analysis. Terms affecting spousal support receive particular scrutiny if enforcement would be unconscionable or the statutory requirements were not met.
Timing matters. The person asked to sign should receive the proposed agreement early enough to understand it, obtain independent legal advice when appropriate, request information, and decide without coercion. A wedding date approaching does not make an incomplete or pressured process safe. Each person should understand which property and debts are being disclosed and whether the agreement uses definitions that differ from everyday language.
What is a postnup?
A postnuptial agreement is an agreement made after marriage. It may be considered when circumstances change, such as a business opportunity, changed finances, inheritance, a new child, a financial crisis, or a desire to clarify property arrangements. Because the parties are spouses, marital fiduciary-duty rules and the actual transaction may be important. The agreement may be evaluated in light of duties of disclosure, management, and fairness that arise during marriage.

That does not mean every postnup is invalid or that every postnup follows the exact rules of a prenup. It does mean the circumstances deserve careful documentation. A postnup presented during a crisis, alongside a threat, or without enough information creates serious enforceability questions.
